1. Definitions
“User Data” means all data provided to TradersPost by or on behalf of User as such data is maintained by TradersPost from time to time.
“Strategy Template” means strategy configuration that a User may publish on the Platform for other Users to clone into their own accounts as independently owned strategies.
“Subscribable Strategy” means a publisher-owned strategy that a User has made available on the Platform for Strategy Subscribing.
“Strategy Subscribing” means a User connecting a brokerage account that User owns or for which User has broker-verified trading authorization to another User’s Subscribable Strategy through the Platform, so that trade instructions generated by that strategy may be routed to User’s connected brokerage firm subject to User’s configuration and authorization. Strategy Subscribing is distinct from cloning a Strategy Template and from any managed-account, copy-trading, or fill-mirroring service.
2. General Disclaimers Regarding Trading
Market Data. Any quotes, prices, charts, or other market data displayed on or through the Platform may be delayed, incomplete, or inaccurate and are provided for informational purposes only. Such data may be subject to third-party exchange, vendor, or brokerage restrictions. User may not redistribute, republish, or commercially exploit any market data obtained through the Platform except as expressly permitted by the applicable data provider’s terms.
Asset-Class Risks. Certain asset classes carry risks in addition to those described above. User is responsible for understanding the risks of each asset class before trading it through the Platform, including:
Futures. Futures trading is highly leveraged: a relatively small amount of money is used to establish a position in assets having a much greater value. User may lose a substantial amount of money in a very short period of time, and losses are potentially unlimited and can exceed the amount User deposited with User’s brokerage firm. Only risk capital should be used when trading futures. User should not risk funds User cannot afford to lose, such as retirement savings, medical and other emergency funds, funds set aside for education or home ownership, proceeds from student loans or mortgages, or funds required to meet User’s living expenses.
Options. Holding options positions whose exercise, assignment, or settlement User’s account cannot support could cause significant overnight risk, such as a low or negative equity situation, a margin call, a cash debit, an Individual Retirement Account (IRA) debit, or an unintended stock or short position, any of which would need to be resolved the day following expiration. Index options (such as SPX, NDX, RUT, and XSP) are generally cash-settled, European-style contracts that cannot be exercised early and may settle in the morning or afternoon depending on the product, which can affect the final settlement value. It is User’s responsibility to manage, and to trade out of, any position User’s account cannot support. User’s brokerage firm may act to reduce such risk and may close positions at any time, but neither TradersPost nor User’s brokerage firm guarantees that such action will be taken.
Cryptocurrencies and Digital Assets. Trading cryptocurrencies and digital assets carries a high level of risk and may not be suitable for all investors. User could lose some or all of User’s investment and should only use risk capital User is willing to lose completely. Cryptocurrencies and digital assets are subject to regulatory uncertainty, and the level of risk in trading them may change as a result.
3. Automated Trading and Technical Risks
User is responsible for actively monitoring brokerage accounts, open positions, and automated activity to confirm they behave as intended. TradersPost does not guarantee uninterrupted automation, execution at any particular price, or any trading outcome.
Assumption of Risk and Release. Automating trades through the Platform may not be suitable for every User, and not every User will be able to do so effectively. Regardless of User’s level of expertise, User should exercise caution when automating trades and be aware of the risks described in this Agreement. BY CONNECTING A BROKERAGE ACCOUNT TO THE PLATFORM OR OTHERWISE USING THE PLATFORM, USER ACKNOWLEDGES AND CONFIRMS THAT USER IS AWARE OF THE INHERENT RISKS INVOLVED IN USING THE PLATFORM AND WILLINGLY ACCEPTS THOSE RISKS. To the fullest extent permitted by applicable law, User releases TradersPost, its parent company, affiliated businesses, and employees from any and all claims, demands, suits, causes of action, liabilities, costs, losses, expenses, and damages that arise from or relate to User’s use of the Platform, including any arising from errors, malfunctions, or downtime in the Platform or in the systems of TradersPost’s vendors.
4. General Terms
Governing Terms. These Terms of Service, along with any additional terms or documents that are referenced herein or that are presented elsewhere on our website, TradersPost.io, in relation to a specific service or feature (collectively, the “Agreement”) govern User’s use of our Platform, and the services provided by TradersPost.
Description of Service. TradersPost is a self-directed automation tool. Users configure and control their own brokerage connections, trading parameters, and automated strategies. Based on User’s configuration, the Platform may receive trading signals or alerts from sources designated by User and route User-authorized trade instructions to User’s connected brokerage firm for execution in User’s brokerage account. Where available under User’s plan and Platform configuration, Users may also (a) publish or clone Strategy Templates so that a recipient creates an independent strategy in the recipient’s own account, and (b) publish Subscribable Strategies or engage in Strategy Subscribing by connecting User’s own brokerage account to a Subscribable Strategy. Availability of Strategy Subscribing (including any automated submission of trade instructions through Strategy Subscribing) may depend on User’s plan and on whether TradersPost has enabled those capabilities for User’s particular brokerage firm based on TradersPost’s discussions with that firm. TradersPost does not guarantee that Strategy Templates or Strategy Subscribing will be available for any particular broker, plan, or strategy. TradersPost does not execute, clear, or settle trades and does not hold User funds or securities. All securities transactions are effected by User’s broker-dealer in User’s brokerage account based on instructions User authorizes through the Platform. User understands and agrees that the Platform is provided “AS-IS” and that TradersPost assumes no responsibility for the timeliness, efficiency, effectiveness, deletion, mis-delivery or failure of any communication or services provided.
5. Limited Right to Use
Content Utilization. TradersPost reserves the right, in its sole discretion, to edit or delete any documents, information or other content appearing on the Platform. The contents of the Platform, whether partial or otherwise including, but not limited to, text, graphics, images, logos, button icons, software, etc., are protected under both United States and foreign copyright, trademark and other laws. All our content is our exclusive property, including any code we create to generate or display our content, any code used within the Platform, or the pages making up any of Platform, or any compilations, collections, arrangements or assembly of content. The use of our content on any other unauthorized use of our content is strictly prohibited.
No Solicitation of Users. Users or Strategies. Users are prohibited from soliciting other users of TradersPost to alternative or competing services. Users are also prohibited from soliciting publishers of Strategy Templates or Subscribable Strategies to make those strategies available outside of the Platform in a manner that circumvents this Agreement.
No Resale of Service, Subscription, or Account. User agrees not to reproduce, copy, duplicate, sell, resell or exploit for any commercial purposes any portion of the Platform, use of the Platform, or access to the Platform. User may not share, transfer, “pool,” or otherwise allow any third party to access or use the Platform or Platform, any paid subscription subscription, or any Strategy Subscribing connection through User’s account or login credentials, whether or not consideration is received. Each natural person who accesses the Platform must have their own account and, where applicable, their own subscription. An entity may register for an account, but only one designated natural person may access, configure, or control that account at any time; entity accounts may not be shared among multiple individuals. If User clones a Strategy Template or engages in Strategy Subscribing, User agrees not to forward, disseminate, or resell the strategy’s contents, signals, or configuration without permission from the publisher, except as expressly permitted by the Platform’s features for User’s own self-directed use. TradersPost may, in its sole discretion, suspend or terminate any account or subscription that it believes is being shared or used by multiple individuals, without refund, in addition to any other remedies available under this Agreement.
8. Self-Directed Use and Prohibited Third-Party Services
Self-Directed Use and Prohibited Third-Party Services
Self-Directed Platform. The Platform is a self-directed automation tool. For purposes of this Section, “personalized human services” means one-on-one operation, configuration, management, or trading direction provided by a person on behalf of a User. TradersPost is not a registered investment adviser, broker-dealer, or managed account service. TradersPost’s fees are subscription-based and are not tied to User’s trading results, account performance, or capital appreciation. TradersPost does not manage User accounts or provide personalized recommendations or instructions regarding User’s trading activity. Users must make their own trading and configuration decisions and are solely responsible for determining whether and how to use the Platform. The restrictions in this Section target personalized human services. They do not prohibit Strategy Templates, Strategy Subscribing where available under Paragraph 7.9, or standardized third-party software, automated signal services, or User-authorized integrations as described in Paragraph 7.8.
User Configuration and Control. User is solely responsible for initiating, authorizing, reviewing, and maintaining the configuration and operation of User’s own account and use of the Platform, including broker connections, strategies, symbols, timeframes, position sizing, risk settings, and all other trading parameters. This responsibility applies whether User configures the Platform directly directly, through Strategy Templates or Strategy Subscribing under Paragraph 7.9, or through permitted third-party software, integrations, imports, templates, or other authorized tools under Paragraph 7.8.
Prohibited Third-Party Operation and Configuration. User may not permit any third party to operate, configure, or manage User’s TradersPost account on User’s behalf through personalized human services. Without limiting the foregoing, no person may perform setup or ongoing configuration of User’s strategies, broker connections, trading parameters, or account settings on User’s behalf; direct User’s trading activity through individualized recommendations or instructions tailored to User’s circumstances; or substitute such person’s judgment for User’s responsibility over User’s account, regardless of whether such conduct occurs in person, by phone, chat, screenshare, remote access, or any other method. Nothing in this paragraph prohibits User’s use of Strategy Templates or Strategy Subscribing under Paragraph 7.9, or User’s use of permitted third-party software and signal services under Paragraph 7.8, including through webhooks, APIs, imports, templates, or other User-authorized integrations.
Credential Sharing Prohibited. User may not share User’s TradersPost login credentials, passwords, or account access with any third party for any purpose, including account setup, configuration, operation, or management. User may not share brokerage login credentials, API keys, or other brokerage account access with any third party for the purpose of connecting, configuring, or trading through the Platform on User’s behalf. Nothing in this paragraph prohibits User from providing User-authorized integration endpoints (such as webhook URLs or other action-scoped endpoints limited to integrations User has approved) to permitted third-party software and signal services under Paragraph 7.8, provided User does not share TradersPost login credentials, passwords, or account access with any third party. This prohibition is in addition to, and does not limit, the restrictions set forth in the Account Passwords and Data Security and Authorized Brokerage Account Use provisions of this Agreement.
Prohibited Managed and Concierge Services. User may not use the Platform as part of, or in connection with, any managed account service, concierge setup service, account operation service, “done-for-you” configuration service, or similar business model in which a third party provides personalized human services. This prohibition does not apply to Strategy Templates or Strategy Subscribing under Paragraph 7.9, or to permitted third-party software and signal services under Paragraph 7.8.
Prohibited Performance-Based Compensation. As a contractual condition of use, User may not enter into any arrangement with a third party under which the third party receives profit share, revenue share, performance-based compensation, or similar remuneration tied to User’s trading activity, results, or use of the Platform, regardless of whether such arrangement is otherwise permitted under applicable law, except for profit splits, payout fees, or similar performance-based compensation owed to the proprietary trading firm or evaluation program operator with which User has a direct account or program relationship, provided such compensation is pursuant to that firm’s official program terms and is paid to the firm or program operator itself. This prohibition applies to individuals, businesses, educators, coaches, service providers, and any other third party who is not the proprietary trading firm or evaluation program operator with which User holds the account. Nothing in this paragraph prohibits flat-fee compensation for permitted educational activities under Paragraph 7.9. 7.10.
Independent Judgment Required. User must retain independent judgment and discretion over User’s selection, authorization, configuration, and ongoing use of the Platform. User may not delegate responsibility for User’s account to a human third party providing personalized human services, and may not rely on individualized directives from a person regarding specific symbols, timeframes, strategies, sizing, broker settings, or other trading parameters in lieu of User’s own decisions. User’s voluntary use of Strategy Templates or Strategy Subscribing under Paragraph 7.9, or subscription to or authorization of standardized third-party software or signal services permitted under Paragraph 7.8 7.8, does not violate this paragraph, provided User independently decides whether to use such feature or service and remains responsible for initiating, authorizing, reviewing, and maintaining User’s configuration and account activity.
Permitted Third-Party Software and Signal Services. Nothing in this Section prohibits User from using third-party software platforms, applications, or automated signal services (including strategy marketplaces and rules-based, algorithmic, AI-powered, or automated trading tools) that offer standardized strategies, alerts, sizing logic, or trade instructions to subscribers or customers on the same terms; may generate or transmit standardized trade instructions, alerts, or automated sizing through rules or algorithms common to all subscribers; and operate through User-authorized integrations such as webhooks, APIs, imports, templates, or similar mechanisms. Permitted services do not include personalized human services. User is solely responsible for determining whether to use any such third-party service and for selecting, subscribing to, configuring, authorizing, reviewing, maintaining, monitoring, and disconnecting any such third-party service, and for all trading activity executed through the Platform as a result.
Strategy Templates and Strategy Subscribing. Subject to this Agreement, User’s plan, and Platform configuration, the Platform may permit Users to (a) publish Strategy Templates for other Users to clone, and clone Strategy Templates and (b) publish Subscribable Strategies and engage in Strategy Subscribing. Strategy Templates facilitate setup only: after cloning, the recipient independently owns and operates the cloned strategy in the recipient’s own account. Strategy Subscribing, where enabled, allows a subscriber to connect the subscriber’s own brokerage account to a Subscribable Strategy; the subscriber remains responsible for initiating, authorizing, reviewing, configuring, monitoring, and disconnecting that connection, including position sizing, risk settings, and whether automated submission of trade instructions is enabled where permitted. Strategy Subscribing does not authorize credential sharing, remote operation of another User’s TradersPost account, real-time fill mirroring between unrelated Users, or managed-account services. TradersPost may enable, limit, or disable Strategy Subscribing (including automated submission capabilities) on a per-brokerage-firm basis based on TradersPost’s discussions with the applicable brokerage firm, and may change such availability at any time. Neither a publisher nor a subscriber may use Strategy Templates or Strategy Subscribing to circumvent the restrictions in this Section on personalized human services. User is solely responsible for evaluating any strategy, template, or publisher and for all trading activity in User’s brokerage account arising from cloning a Strategy Template or from Strategy Subscribing.
No False Authorization or Endorsement. User may not permit any third party to represent that TradersPost authorizes, endorses, licenses, or is affiliated with the third party’s services for the purpose of providing personalized human services, performing managed or concierge account services using the Platform, or providing individualized trading direction.
Reservation of Rights. TradersPost reserves the right to determine, in its reasonable discretion, whether a third-party service or service, business model model, Strategy Template, or Strategy Subscribing arrangement complies with this Section and is consistent with the self-directed nature of the Platform and may prohibit integrations or suspend or terminate accounts that use or participate in services that circumvent or violate the restrictions in this Section.
10. Third Party Services and Products
Third Party Services and Products. TradersPost reserves the right to offer third party services and products to User based on the preferences identified in User’s Registration and at any time thereafter; such offers may be made by TradersPost or by third parties. For clarity, third-party services and products under this Section means integrations, tools, and offerings that User may connect to or use with the Platform (such as brokerage, data, infrastructure, or permitted third-party software and signal services under Section 7), and does not include human-operated account operation, concierge setup, or managed account services, which remain prohibited under Section 7. Strategy Templates and Strategy Subscribing under Section 7 are Platform features among Users and are not third-party products or services under this Section; TradersPost does not endorse, authorize, or guarantee any publisher’s strategy, template, or trading results. Without limiting any of the other disclaimers of warranty set forth in these Terms, TradersPost does not provide or make any representation, warranty or guarantee as to the quality, nature, accuracy or fitness for any purpose of any third-party products or services. Any such undertaking, representation, warranty or guarantee would be furnished solely by the third-party provider of such products or services and subject to that provider’s Terms of Service. The Platform may contain links and pointers to websites operated by third parties. These links are provided solely as a convenience to User and not as an endorsement by TradersPost of the contents of such third-party websites. TradersPost is not responsible for the content of linked third-party websites and does not make any representations regarding the content or accuracy of materials on such third-party websites. If User decides to access linked third-party websites, User does so at his or her own risk.
